The move comes after a federal judge Barbara Crabb asked the ACLU to draft an order, laying out how it wants her decision to strike down Wisconsin's same sex marriage law to be implemented.
The proposed language would require county clerks to issue marriage licenses to same-sex couples and recognize those marriages.
Wisconsin attorney general J.B. Van Hollen has filed several appeals and has called for county clerks to wait on issuing marriage licenses to same sex couples.
The ACLU is challenging the discriminatory ban on behalf of eight couples seeking the freedom to marry in Wisconsin or to have their out-of-state marriages recognized.'
