WFRV- Attorney General Brad Schimel filed an emergency motion late Tuesday afternoon to prevent Brendan Dassey from being released from Columbia Correctional Institution.

Schimel filed a request asking a judge to block the release of Dassey until Wednesday by 4 p.m. The motion claims the state will file an emergency motion to keep Dassey in prison by the close of business Wednesday.

Dassey was convicted of helping his uncle, Steven Avery, rape and kill Teresa Halbach. Dassey was sentenced to life in prison in the 2005 slaying.

A judge overturned Dassey’s conviction in August and on Monday said he should be released while prosecutors appeal.
