A federal court ruled Wednesday that Brendan Dassey will stay in prison.

“It is ordered that the motion to lift the stay is denied,” the order read.

This comes after his attorneys asked on Tuesday for his immediate release. Dassey’s attorneys filed a 10-page motion in response to the state’s opposition that was filed Monday afternoon. The state of Wisconsin asked to keep Dassey in prison while they appealed the ruling overturning his conviction.

State prosecutors said Monday that they will be asking the full Seventh Circuit Court of Appeals to hear Dassey’s case.

Dassey is to stay in prison while the appeal is being considered.
