A federal judge has tossed the conviction of Brendan Dassey, the nephew of Steven Avery, and the alleged accomplice in the murder of Teresa Halbach.
The 91-page decision was made by Federal Judge William Duffin of Milwaukee.
Dassey wont be released immediately, as the judge gave prosecutors 90 days to start the process to retry the 26-year-old again.
Dassey and his Uncle Steven Avery, were convicted in the 2005 murder of Teresa Halbach, a freelance photographer who went to the Avery’s property to take pictures for a car sales magazine.
The case was the basis for the Netflix documentary series, “Making a Murderer.”
Dassey’s attorney, Len Kachinsky, spoke to Local 5 and says he regrets how some aspects of the case were handled.
“I was representing him, because of the continuous conflict between Dassey’s family and me over what they thought we ought to be doing,” he said, “and then afterwards, the post conviction proceedings that included the claims of ineffective assistance by council.”
Local 5 News has reached out to the Avery family but they did not have any sort of comment.
