For the second time in a week, Brendan Dassey’s attorneys are asking for his immediate release from prison.
On Tuesday, attorneys filed a 10-page motion in response to the state’s opposition that was filed Monday afternoon. The state of Wisconsin asked to keep Dassey in prison while they appealed the ruling overturning his conviction.
State prosecutors said Monday that they will be asking the full Seventh Circuit Court of Appeals to hear Dassey’s case.
In Tuesday’s motion, it states:
The departure that the State seeks from the common practice of granting bond to successful habeas petitioners in Dassey’s position is not warranted. The State has lost its appeal and is now highly unlikely to prevail in its efforts to seek reversal. This Court should lift its stay of the district court’s order releasing Petitioner-Appellee Dassey. He has been unconstitutionally incarcerated long enough.
