APPLETON, Wis. (WFRV) – A Green Bay man, 40-year-old Gustavus Dalton, Jr., has been sentenced in Outagamie County Court for drunk driving with three children in the vehicle last summer.
In June 2019, emergency crews were dispatched to CTH EE at CTH C in the Town of Oneida after Dalton failed to stop for a stop sign and was struck by a pickup truck.
Two of the children in the vehicle – a 4-year-old and a 6-year-old – were transported to an area hospital for treatment. Authorities say they were both wearing seat belts during the crash, but were not in a booster seat. A third child – a 3-year-old – sustained minor injuries and was treated on scene.
Dalton told officials he had been drinking while driving. He was initially charged with two counts of injury by intoxicated use of a vehicle, one count of OWI (fourth offense with passenger younger than 16), and one count of operating with PAC with passenger younger than 16, fourth offense. In December, Dalton was found guilty of both counts of injury by intoxicated use of a vehicle. The other two charges were dismissed.
On Monday, Dalton was sentenced to two years in prison followed by five years of extended supervision. Court records show his driver’s license has been revoked for 10 years.
Man charged with 4th OWI waves preliminary hearing

APPLETON, Wis. (WFRV) — Gustavus Dalton, Jr., 39, has waived his preliminary hearing in Outagamie County Court Wednesday afternoon.
Dalton’s next court appearance will be his arraignment on July 30.
Driver charged with 4th OWI, held on $75,000 cash bond

APPLETON, Wis. (WFRV) — The suspected drunk driver in the Town of Oneida crash appeared in county court Wednesday.
Gustavus Dalton, Jr., 39, of Green Bay, faced one count of Operating a Motor Vehicle while Intoxicated – 4th Offense, with a Minor Child in the Vehicle and two counts of Injury by Intoxicated Use of a Vehicle – Great Bodily Harm, General Alcohol Concentration.
The criminal complaint outlines more details of the incident which occurred Monday evening.
The report says officers were dispatched to the two-vehicle crash just after 7 p.m.
An Outagamie County Sheriff’s deputy reported hearing over the scanner while on his way to the scene that “one individual [was] ejected from a vehicle and that there was a seven-year-old girl who was unconscious but breathing.”
The deputy went on to say he heard other deputies call for a helicopter to transport a juvenile.
Upon arrival, the deputy says they made contact with Dalton, who “was holding two juvenile females near the crash.”
One of these females was a four-year-old who the deputy observed to have “blood on the…face and ankle.”
Dalton reportedly told the deputy “he had gone through the intersection and then the rear end of his truck was struck by another vehicle.”
Once his vehicle stopped, “he got out and located [the aforementioned child] laying in a nearby parking lot.” He told the deputy the child had been ejected.
A second helicopter was then dispatched, according to the report.
The man then told the deputy another child, a six-year-old, had been in his vehicle and was the cause for first helicopter to be called in.
While talking to the man, the deputy reportedly observed him “to have glossy eyes.” The deputy goes on to say he “observed the odor of intoxicants coming from his person as well.”
The driver, when asked where he was driving to and from, he reportedly told the deputy “he was just driving around.” He went on to tell the deputy he had stopped at the sign and the girls in his vehicle were in the backseat. According to the report, one of the girls, a three-year-old, was in a booster seat. The other two were belted, but “not in booster seats as their ages and sizes would have required them to be.”
The document went on to explain Dalton, when asked about alcohol consumption, “confirmed he had consumed two ‘tall boy’ cans of ‘Hurricane.'” Dalton reportedly later confirmed the cans were 16 ounce cans.
Dalton reportedly told the deputy he drank these before driving, but later “[indicated] that he was actually consuming the beverages in the vehicle as he was driving with the girls in the rear seat.”
After field sobriety tests, the deputy placed Dalton under arrest. He was then transported to a local hospital for a blood test to determine his alcohol level.
Dalton later “admitted to drinking with the girls in the rear seat.”
He then went on to say “he thought he was ‘ok to drive, but [he] probably wasn’t.” The report says Dalton also indicated, “I know I broke the law.”
Deputies also spoke to Ricky Leach, the other driver involved in the crash.
Leach reportedly told deputies “he approached the intersection and saw the defendant’s vehicle.”
He continued, saying he “observed [Dalton’s] vehicle slow down as through it was going to stop and that he thought it was going to.” Dalton’s vehicle, according to the document, did not stop.
Leach told deputies he attempted to swerve, but was unable.
Dalton is currently being held on a $75,000 bond.
Officials release information about injured girls in Oneida crash
TUESDAY 6/25/19 1:12 p.m.
TOWN OF ONEIDA, Wis. (WFRV) — The Outagamie County Sheriff’s Office has released more information regarding Monday night’s accident involving three young girls.
Officials say the 39-year-old Green Bay man who was driving the vehicle with the three girls was arrested for suspicion of operating while intoxicated. He is currently being held at the Outagamie County Jail and is making his initial court appearance Wednesday afternoon.
The man, according to the Sheriff’s Office, is the father of the children in the hospital and the guardian of the 3-year-old.
The two children, ages 4 and 6, taken to the hospital by helicopter remain hospitalized.
Officials say the child they previously identified as 5 years old is actually 3 years old. She received minor injuries and was treated at the scene.
The intersection remains closed but is expected to open around 2 p.m. Tuesday.
Officials say they are continuing to investigate the crash.
Three girls injured, two airlifted to hospital, after two vehicle crash in town of Oneida

TOWN OF ONEIDA, Wis. (WFRV) — Three young girls were injured Monday night in a two vehicle crash in the town of Oneida, with two of them being airlifted by helicopter to a local hospital.
The crash occurred at the intersection of County Highways C and EE just after 7:00 PM. A 39-year-old Green Bay man was driving an SUV eastbound, when he failed to stop at a stop sign. As a result, his vehicle struck a truck driven northbound by a 58-year-old Dale man.
The crash occurred at such a force that both vehicles landed in a nearby restaurant parking lot.
The 39-year-old man had three young female passengers, believed to be ages four to six. All three of the girls suffered injuries, with two of them going to local hospitals. The extent of their injuries is unknown.
The Outgamie County Sheriff’s Office say the Green Bay man was arrested for operating a vehicle while intoxicated.
County Highway EE is expected to remain closed for the time being.
